The terms and conditions of this Patient Contract apply to all services and procedures carried out by Wimpole Clinic Ltd. These Terms & Conditions take precedence over the contents of any literature or written material provided by Wimpole Clinic Ltd to the patient where such contents conflict with these Terms & Conditions. 

1. DEFINITIONS

1.1   “Wimpole Clinic”, or “The Company” means Wimpole Clinic Ltd

1.2   “Patient information” refers to the information supplied by Wimpole Clinic Ltd to its patients both written and/or in the media (website, Instagram etc).

1.3   “Procedure” refers to the intervention carried out by a Surgeon engaged under the services of Wimpole Clinic Ltd.

1.4   “Surgeon” means a qualified medical practitioner registered with the appropriate regulatory body (GMC, RCS, RCGP).

1.5   “Patient” means any person who has entered a contract for a procedure

1.6   “Initial aftercare plan” means the surgical aftercare included in your hair restoration plan.

1.7   “Cost” is the total hair restoration plan price agreed between the Wimpole Clinic Ltd and the patient.

1.8   “Hair restoration plan” includes surgical grafts   and hair medication therapy.

1.9   “Initial Consultation” is a pre-operative consultation with Wimpole Clinic Ltd or representative.

1.10 “Surgical consultation” is the point at which the surgeon meets or has a remote consultation to assess suitability to the procedure.

1.11 “Additional grafts” are any extra grafts taken on the day of surgery deemed necessary more than the restoration plan.

2 OBLIGATIONS & WARRANTIES 

2.1   Surgeons are registered with the General Medical Council and are obliged to maintain full private practice indemnity insurance.

2.2   The patient warrants that they have read the Terms and Conditions and the consent form and fully understand the limitations, alternatives, risks, rationale, and benefits of the procedure.

2.3   Wimpole Clinic Ltd will provide hair transplant surgery and medication therapy as outlined in the plan.

2.4   Additional grafts may be discussed, quoted, and agreed on the day of surgery at extra cost. These are beyond the original treatment plan.

3 PATIENT’S OBLIGATIONS 

3.1   This contract is conditional upon the acceptance of the patient by the surgeon based on the information provided in the initial and surgical consultations. The decision to proceed will be at the discretion of the Surgeon.

3.2 Payment is due at least one week  prior to surgery.

3.3   Payment for an additional graft agreed on the day of surgery must be made prior to surgery proceeding.

3.4   The patient acknowledges that patient representatives where used are not medically qualified. Any advice that the representative may give is purely of a general non-medical nature.

3.5   The patient agrees to provide accurate and honest medical information, with the understanding that withholding information may prove detrimental to the outcome of the hair transplant.

3.6   The minimum age of any consultation or surgical procedure is 18 years old.

3.7 If a Wimpole Clinic doctor advises the patient to have a biopsy prior to their hair transplant and the patient decides against this, the patient agrees to assume any and all risks associated with this decision. These risks may include the potential for an undiagnosed or untreated scalp condition that may compromise the success of the transplant; the possibility of unexpected complications or poor healing outcomes; the risk of exacerbating any existing or underlying medical conditions that may affect hair growth or scalp health. The patient confirms they have had the opportunity to discuss this matter thoroughly with their healthcare provider, including the potential risks and consequences of forgoing the biopsy.

4 GENERAL OBLIGATIONS 

4.1   Wimpole Clinic Ltd reserves the right to alter the date of surgery and/or outpatient appointments, although such changes will be avoided whenever possible. The patient agrees that no consequential loss will be payable for such cancellation on any procedure/appointment.

4.2   The patient agrees that in signing this set of terms and conditions and the consent form that he/she has understood the terms and has been given an opportunity to seek explanation.

4.3   The patient accepts that Wimpole Clinic Ltd.’s liability for breach of contract is limited to the operation cost.

4.4   The patient will be required to read and sign the consent form prior to surgery.

4.5   In the interest of the patient and their welfare, we reserve the right to cancel or postpone your procedure.

5 RESCHEDULING/CANCELLATIONS 

5.1   If you need to reschedule your surgery, an administration fee will apply as follows: 21 days or less notice – £75, 14 days or less notice – £250, 7 days or less notice – £500. This policy does not affect the 14-day period of reflection (section 5.2).

5.2   Cancellation of bookings – we recommend, as per the Royal College of Surgeons guidance, that you have a ‘cooling-off’ period of 14 days after consultation to consider all aspects of the procedure. After the 14-day period of reflection, the following monies would be retained/payable to defray some of the costs incurred:

5.3   Cancellations for medical reasons

–        If due to unforeseen medical circumstances, the refund of monies will be paid in full.

–        If due to pre-existing medical conditions, but undisclosed prior to booking, the procedure will be paid in line with section 5.2 of this contract.

–        If the procedure is abandoned intra-operatively due to unforeseen medical conditions, Wimpole Clinic Ltd will retain sufficient monies to cover the costs incurred by the company as reasonably deemed fit and in accordance with the conditions detailed at 3.1 and 4.4.

6 COMPLAINTS/READMISSION  

6.1   The complaints procedure is available on request. If you have a complaint regarding any aspect of your treatment, we recommend that you discuss this with your surgeon or patient representative in the first instance.

6.2   Aftercare – The initial aftercare period will include on-going post-operative review appointments up to 24 months after surgery. Any subsequent treatment will be quoted and charged separately.

6.3   Readmission – If your surgeon decides that the results of the hair transplant are acceptable and within the normal limits of surgery, then further surgery would incur the full fee. If, however, your surgeon agrees that your surgery did not meet expectations within the normal limits of surgery and the natural progression of hair loss, and the results were not compromised due to negligence on the part of the patient, then Wimpole Clinic Ltd will consider contributing towards the surgical costs. Wimpole Clinic Ltd will assess the circumstances of each patient and each procedure separately in determining the basis on which further surgery may be provided at any discount. The surgeon will make the ultimate decision in readmissions and the Company’s decision is final.

6.4   The complaints/readmission policy is limited to the original hair restoration plan. The patient acknowledges that results of surgery can take 12- 18 months for final growth. Hair loss is progressive, and more native hair may be lost during this period. Full hair restoration may require further surgeries as a staged approach.

6.5   If the patient fails to follow advice and guidance given (both pre- and post-operative) or to attend review appointments, or where the results of the surgery originally provided have been affected by changes in lifestyle, illness, or the natural ageing process, Wimpole Clinic Ltd cannot commit to providing continuing surgery at special rates.

7 CONFIDENTIALITY 

7.1  Wimpole Clinic Ltd and the Patient agree that all matters arising relating to the Patient’s treatment will be kept confidential, save where he/she is required to disclose such material to relevant members of medical staff and/or relevant government authorities, be they regulatory or otherwise.

7.2   The patient confirms his or her consent to the disclosure of personal information by Wimpole Clinic Ltd to surgeons, doctors, nurses, and other medical staff for the purpose of discussing patient’s treatment.

7.3   If required, your surgeon/Patient representative will provide you with the policy on access to your medical records.

7.4   During admission, photographs will be taken. They will remain part of your medical file.

7.5 Complaints and Public Statements

We kindly ask all patients to utilise our formal complaints procedure, which enables us to address concerns fairly, promptly, and constructively. If a complaint is not submitted through the appropriate internal channels and is instead made public or shared externally without allowing us the opportunity to respond:

  • We reserve the right to issue a Letter of Claim under the Pre-Action Protocol for Defamation, as outlined in the Civil Procedure Rules, should any public statements or online content contain false, misleading, or defamatory remarks that harm the reputation of the clinic or its staff.
  • Any negative public statements or online posts concerning your treatment that are made without first completing our internal complaints process may be deemed defamatory. In such cases, we may pursue legal action if the content is published without prior engagement in our resolution procedures. This may result in you being liable for damages as well as our legal costs in pursuing any defamation claim against you.

8 JURISDICTION  

8.1   The laws of England and Wales shall apply to the contract and the courts of England & Wales shall have exclusive jurisdiction.

8.2   Wimpole Clinic Ltd reserves the right to change terms and conditions at any time. The latest Terms & Conditions are available on request from our Patient Representatives or via the surgeon.

Confidentiality 

The Wimpole Clinic asks patients to provide personal information about their current and past health. Our clinic staff have access to your information solely to identify you as a patient and determine the most appropriate hair restoration treatment for you. Your information is held securely and confidentially.

Our health regulator, the Care Quality Commission (CQC), may review your information during an inspection. In some cases, depending on your health and the treatment you are seeking, we may share your health information with third-party laboratories or healthcare specialists for a medical or surgical opinion before proceeding with your treatment. Additionally, if you opt to upgrade to one of our packages, we will share only the relevant information with our concierge partners to arrange your travel and accommodation on our behalf.
